Flat Fees
Some law firms offer services for a flat fee. This is especially true of high volume law firms that handle many cases but spend little time on each. For instance, a law firm might offer to do a Complaint for Divorce for $2,000.

Flat fees let clients know how much services will be ahead of time. But the lawyer has little incentive to spend the time necessary to do a good job. Flat fees are often used by lawyers who do generic and mediocre work. For instance, a lawyer's assistant can easily replace the names on a Complaint for Divorce done for another client, spending a total of about 15 minutes, and then collect the $2,000 flat fee.

Hourly Billing​
Legally sophisticated clients like large businesses and insurance companies usually want hourly billing, because they can see that the lawyer is spending the time to do the work well. With hourly billing, lawyers and staff will charge a set amount per hour.

Hourly billing ensures that enough time is spent to do good work. But clients are reasonably concerned that there is no limit to how much time a task might take or how many hours will be billed. A client might expect a matter to take only five hours, at a cost of $1,500, and then be surprised when it takes 15 hours at a cost of $4,500.

Momentum gives clients the best of both worlds. It charges clients hourly, but guarantees that certain services will not cost more than a certain amount: any work beyond that is done for free.

For instance, Momentum might anticipate that a motion for temporary support will take 10 hours, at $300 per hour, for a total cost of $3,000. The motion would include sending a letter trying to resolve the issue, drafting the motion, drafting a reply to any opposition, and arguing the matter at a hearing. It is possible that after sending the letter, a resolution is reached, taking only 1 hour. In this case the client is only charged $300 for 1 hour of the attorney's time. But it is also possible that the work takes 20 hours. In this case, rather than charging $6,000 for 20 hours, under Momentum's Honest Pricing, the client is only charged the $3,000. Clients get the best of both worlds. Honest billing, with a no-surprise guarantee.
