Alternatives to Litigation

Collaborative Divorce / Collaborative Custody
Collaborative divorce is a process in which a facilitator, also called a coach, works with each spouse and their attorney through a series of negotiations. If there are substantial financial issues, a financial advisor usually assists the parties. If there are child custody issues, a child therapist or other child expert is usually hired to assist. Mr. Spradling is trained and certified in Collaborative Divorce as both an attorney and a facilitator.
Mediation
In mediation, a neutral third party (the mediator) helps the parties settle their dispute. Mediation has a high rate of success and is much less expensive than litigation. It also allows the parties to avoid the risks associated with trial and maintain some control over the outcome. Although mediation can happen at any time, it is most commonly used after the parties and their attorneys have developed their cases and are ready for trial.
Amicable Resolution
For people who want to understand their legal rights and come to a fair agreement, but also want to minimize the expense and mudslinging usually associated with litigation, the Momentum Law Group offers amicable resolution. In an amicable resolution, Mr. Spradling will meet with each side and learn the relevant facts. He will then put together a plan to resolve the issues, which may include obtaining documents and appraisals. He will then meet with both parties and mediate any outstanding disputes. Finally, the Momentum Law Group will draft the necessary court documents to finalize the divorce on terms agreed to by the parties.
